US Supreme Court will not hear case trying to kill the RFS
In Washington, the US Supreme Court has ruled that it will not hear a case brought forward by the National Petrochemical and Refiners Association, along with the American Petroleum Institute seeking to strike down the Renewable Fuel Standard. According to USAgNet, the request centered on whether a federal agency that misses a statutory deadline for writing regulations may engage in retroactive rulemaking based on implied, rather than express, authorization from Congress.
