API files second lawsuit against EPA over 2011 cellulosic requirement

In Washington, the American Petroleum Institute has filed its lawsuit against EPA over the cellulosic requirement in the 2011 Renewable Fuels Standard requirements. This comes as the second case the API is laying against the EPA over the RFS, one for the 2012 standard and one for the 2011. Both cases are “essentially arguing the same thing,” says Carlton Carroll, spokesperson for the API; both cases argue that since there are no cellulosic RINs to date, the EPA has no authority to mandate the purchase of cellulosic fuels. The 2012 case was filed earlier this year in March.
