Out-of-state oil refiners and biofuel producers sue California over cleaner-fuel legislation

In California, a case has been sent to the 9th U.S. Circuit Court of Appeals in San Francisco to evaluate the constitutionality of California’s Low Carbon Fuel Standard. The LCFS requires petroleum refiners, fuel distributors and other industry players to produce cleaner-burning fuels specifically for the California market, but out-of-state oil refiners and biofuels producers claim the legislation gives an unfair advantage to in-state fuels producers.
