U.S. Court of Appeals backs DOE biofuel decision but opens door to challenges

In Ohio, the U.S. Court of Appeals for the Sixth Circuit has ruled that the DOE complied with the EPA’s environmental assessment requirements when it awarded a grant of $100 million to Frontier Renewable Resources to build a 20 million gallon cellulosic ethanol plant. Sierra Club and a private person living near the plant site had sued the DOE for supporting the plant on grounds of the person’s poor health. Legal analysts say, however, that the ruling could make it easier for challengers to oppose projects for health or environmental reasons.
