DuPont seeks to intervene in ethanol industry suit against EPA for RFS cuts

In Washington, DuPont has filed a motion to intervene in the case brought against the Environmental Protection Agency by American Coalition for Ethanol, Americans for Clean Energy, Biotechnology Innovation Organization, Growth Energy, National Corn Growers Association, National Sorghum Producers and the Renewable Fuels Association in the DC Circuit Court of Appeals saying that the lower cellulosic ethanol volume mandated under the RFS puts the company’s cellulosic ethanol investments at risk. Part of the reason for the RFS was to promote investment in advanced biofuels, which DuPont did by investing in the commercial-scale cellulosic ethanol plant in Nevada, Iowa but the policy shift has put the viability of that investment at risk of economic failure.
