Fiberight’s competitors in Maine sue state to overturn licenses

In Maine, owners of the Penobscot Energy Recovery Company have sued the Maine Department of Environmental Protection in an attempt to overturn the licenses granted to Fiberight for construction of a MSW-to-ethanol plant that would be a direct competitor to its business. The suit filed in Kennebec County Superior Court outlines seven grievances it believes are grounds for having the licenses overturned, ranging from failure to demonstrate technical and financial capacity to implement the project to specific issues dealing with the current state of the project site. The suit goes as far as to say the agency’s issuance of the licenses is “arbitrary”.
