NBB may face uphill battle in court case against EPA’s invitation for Argentine biodiesel imports

In Washington, the National Biodiesel Board argued in the DC District Court on Thursday that the letter the Environmental Protection Agency sent to the Argentine biodiesel association last year inviting imports from “qualified land” equated to rulemaking by the agency and so should be thrown out. Bloomberg analysts say the NBB will have a hard time with the case because of a similar situation was instead thrown out by the same court last week saying there was no agency action to review.
