California Supreme Court sides with Poet on first of two pending CARB cases

In California, the state’s Supreme Court has sent the case known as Poet I back to Fresno County Superior Court rather than hearing the case itself, denying the state’s Air Resources Board’s request to review the appellate court decision that basically put the onus on the board to undertake a review of the Low Carbon Fuel Standard’s NOx emissions. The decision is expected to impact the other case pending in Fresno County Superior Court, referred to as Poet II, challenging the LCFS and Alternative Diesel Standard. That case is set for a hearing on December 21, 2017.
