EPA claims commercially sensitive information reason for requesting waiver case brief be sealed

In Colorado, DTN reports that the Environmental Protection Agency is trying to ensure its opening brief in a case currently being heard in the 10th Circuit Court of Appeals in Denver regarding small refinery waivers be sealed, claiming that some of the information being provided is commercially sensitive. The Renewable Fuels Association, National Corn Growers Association, American Coalition for Ethanol and National Farmers Union, with the support of Farmers Union Enterprises filed suit against the EPA in May 2018 regarding applications to exempt refineries in Wynnewood, Oklahoma; Cheyenne, Wyoming and Woods Cross, Utah from complying with the Renewable Fuels Standard.
