U.S. Court of Appeals dismisses ABFA’s suit against EPA but concerned about agency’s actions

In Washington, DTN reports that U.S. Court of Appeals for the District of Columbia Circuit dismissed the Advanced Biofuels Association’s May 2018 lawsuit against the Environmental Protection Agency that claimed the agency overstepped its bounds granting so many hardship waivers to small oil refineries. Even though the court dismissed the case, DTN reports it said “To be sure, the EPA’s briefing and oral argument paint a troubling picture of intentionally shrouded and hidden agency law that could have left those aggrieved by the agency’s actions without a viable avenue for judicial review,” in its order.
