EPA chooses to not appeal SRE court ruling but four small refiners do

In Washington, Reuters reports that the Environmental Protection Agency did not file an appeal to the decision by the 10th Circuit Court of Appeals on small refinery exemptions made in January, which the American Fuel & Petrochemical Manufacturers calls “astonishing” and “effectively ends the small-refinery exemption program,” a move that has been praised by the biofuel industry who has suffered under the expansion of the SRE program since President Trump entered the White House. The biofuels industry is suffering from falling demand due to the coronavirus pandemic and had pushed for the court ruling to remain in place to help survive the crisis.

DTN reports that Wynnewood Refining Company LLC in Wynnewood, Oklahoma, HollyFrontier Cheyenne Refining LLC in Cheyenne, Wyoming; HollyFrontier Refining and Marketing LLC; and HollyFrontier Woods Cross Refining LLC in Woods Cross, Utah all filed appeals to the ruling.
