In California, Tesoro Refining & Marketing has filed suit against the California Air Resources Board over a requirement that forces refiners to increase ethanol content from 5.7 percent to as much as 10 percent on or before 12/21/2009. Tesoro said in its suit that questions over the environmental impact of ethanol require a more through review by the Board before increasing the local ethanol requirement. The suit requests a temporary injunction to stop enforcement of the new ruling while the suit is pending.
