Tate & Lyle sues Whitefox over membranes; Whitefox countersues over negligence

Somewhere in the US, UK-based Tate & Lyle is suing UK-based Whitefox for what it claims is misrepresentation and breach of contract regarding the special membranes that were installed at the Loudon, Tennessee and Fort Dodge, Iowa ethanol facilities.

Evidently the dispute has been going on since 2009 but it is only reaching headlines now as Whitefox is countersuing for alleged negligence in its treatment of the membranes and of failing to protect Whitefox’s intellectual property rights. Tate & Lyle sold the Fort Dodge plant to Cargill for $58.3 million after it mothballed the plant a few years earlier, and took a $351.5 million write down.
