POET’s two cases against California’s LCFS could result in suspension or major changes

In California, two court cases brought by POET against the state’s Low Carbon Fuel Standard have the potential to significantly change policy by either suspending the LCFS or by eliminating diesel from the law’s deficit and credit mechanism. The cases come in response to cases the company won against the LCFS in appellate court in 2013 that led to reworking the policy that was then readopted in 2015 but POET was back at it just over a month later with another challenge.
