Sen. Grassley says EPA has received DOE guidance on SRE “gap” requests

In Washington, Reuters reports that Senator Chuck Grassley says the Environmental Protection Agency has received guidance from the Department of Energy on the 58 “gap” requests for small refinery hardship waivers. Although the EPA didn’t respond to a request for comments, the senator says receipt of the guidance triggers the 90 days review period the agency has to look over the DOE’s recommendations before it must make a decision. The rush to file for and get “gap” requests approved is in response to the 10th Circuit court ruling in January that rejected how the EPA had been approving some SRE requests, putting its methodology into doubt.
