EPA publishes consent decree for one of its pending SRE court cases

January 5, 2021 |

In Washington, the Environmental Protection Agency has published a consent decree for public comment that would seek to settle one of its pending cases with small oil refiners—in this case with United Refining Company—over failure to make a decision regarding approvals of small refiner exemptions under the Renewable Fuel Standard. The EPA didn’t make a decision on the company’s 2019 SRE request and has a total of 32 pending requests from 2019, along with another 14 pending from 2020. The consent decree published by the EPA would force the agency to make a decision on the company’s request by February 19, 2021.
