US Supreme Court says no to Iowa ethanol Clean Air Act case

In Washington, the US Supreme Court has decided to not hear a an appeal of a June 13 Iowa Supreme Court decision against Grain Processing Corporation regarding complaints made by residents near its ethanol plant near Muscatine, Iowa. The residents sued the company for nuisance, trespass and negligence claims while seeking damages related to “diminished the use and enjoyment of their properties” as a result of the plant’s emissions. GPC argues the EPA and related state agencies regulate the Clean Air Act, providing a process for public input, which a district judge agreed with in 2013. The Iowa Supreme Court overturned the ruling however.
