Small U.S. refiners plan to challenge biofuel blending waiver denials

In Washington, Reuters reports that following the Environmental Protection Agency’s rejection of 15 small refinery waivers last week, that some of those refiners plan to sue the EPA in response, claiming its decision was “arbitrary, capricious, and contrary to law”. The EPA has yet to approve an SRE since President Biden took office, so it shouldn’t have been a surprise according to analysts, but the oil industry is still upset about the hundreds of millions in RIN obligations it would have to cover should the waivers not be granted.
