India’s National Company Law Appellate Tribunal suspends ethanol price fixing ruling on sugar mills

In India, the Hindu Business Line newspaper reports the National Company Law Appellate Tribunal (NCLAT) has suspended a $4.56 million fine for alleged ethanol price fixing lobbed on 18 sugar mills and two trade associations by the Competition Commission of India (CCI) in 2018. The NCLAT has sent the decision back to the CCI for review due to process discrepancies. Whereas three members of the CCI made the ruling, there had been six members taking part in the hearings, which the NCLAT says goes against the ‘one who hears must decide’ principle.
