EPA administrator nominee wants to consult general counsel before deciding on SREs

In Washington, Reuters reports that President Biden’s pick for administrator of the Environmental Protection Agency told the Senate committee interviewing him for the role he needs to discuss the situation of small refinery exemptions with general counsel to understand the current legal intricacies of the case. He said that waiting for the Supreme Court’s ruling on a related case, set for hearing in April, is one way to resolve the situation but wants to understand directly from general counsel what the different options are in order to move forward.
